Levenes solicitors have been successful in recovery compensation for their client Miss MM following a road traffic accident in which she was crossing the road and hit by a stolen motorbike.
Miss MM was travelling home from work one evening. She got off a bus and then needed to cross the road. Her last memory was being on the bus.
CCTV showed that she got off the bus and was crossing the road where the speed limit was only 20 mph when 2 young men riding a stolen motorcycle at high speed collided with Ms MK.
Serious Leg Injuries
She suffered very serious injuries including a head injury and serious fractures to her leg, soft tissue damage and scarring. She was at risk of losing her leg, such was the severity of her injury.
Thanks to the skills of the surgical team, and her own determination, she made a remarkable recovery. She was treated with an external fixation device to enable her broken bones to heal.
Before the accident, Miss MM enjoyed exotic dancing. Remarkably, even before the fixation device was removed, she began gentle dance moves, which may well have helped with blood circulation and speeded up recovery. They also helped her mentally as she had something to focus upon as she recovered from the accident.
The rider of the motorbike was caught by the police and prosecuted for an offence of causing serious injury by dangerous driving and sentenced to 42 months imprisonment. He was also disqualified from driving for 5 years.
The insurers of the bike were legally liable to pay damages even though the bike was stolen, and shortly after the issue of court proceedings, settlement was agreed.
“It was important in this case that there was CCTV which the police obtained resulting in the conviction”, said Tim Beasley. “It also shows that even if a vehicle has been stolen, there is usually a way for compensation to be paid if the driver of the stolen vehicle causes an accident”.
